HBO Seeks to Unmask Euphoria Spoiler Account with DMCA Subpoena

HBO has taken legal action to identify the person behind a fan account on X (formerly Twitter) that allegedly leaked spoilers for the upcoming third season of Euphoria. This move comes just before the highly anticipated premiere, reflecting HBO's vigilance against leaks, a problem it has faced with previous shows like Game of Thrones and House of the Dragon. The fan account, known as 'Lexi howard’s cat', has been active for some time, but recent posts caught HBO's attention, prompting Warner Bros. Discovery to issue a takedown notice for what they described as spoilers from unaired episodes.

X quickly complied by removing the posts, but HBO escalated the matter by obtaining a DMCA subpoena from a California federal court. This subpoena compels X to provide detailed information about the account holder, including personal and contact details. The process of obtaining such a subpoena is relatively straightforward, requiring only a court clerk's signature.

The nature of the alleged infringement is somewhat ambiguous. While the DMCA notice referred to the content as video or audiovisual recordings, the court declaration described it as summaries of unpublished content, which might not be as strongly protected under copyright law. However, the declaration also mentioned access to unpublished, copyrighted work, suggesting a more serious breach.

X and the account holder have until April 23 to contest the subpoena, but no legal challenges have been filed yet. Meanwhile, the account in question has disappeared from the platform.
