Michigan Child Safety Bills Withdrawn Amid Privacy Concerns

In Michigan, two bills aimed at enhancing child safety through digital age verification were pulled from the legislative process after privacy concerns were raised by advocacy groups. The Digital Age Assurance Act, comprising House Bill 4429 and Senate Bill 284, proposed that device manufacturers estimate users' ages and transmit this information to apps and websites. Critics, including the Michigan Fair Elections Institute, argued that the bills lacked essential privacy protections, such as data use restrictions and deletion requirements. They feared the creation of a persistent identity layer without adequate safeguards.

Patrice Johnson from the Michigan Fair Elections Institute highlighted the potential negative impact on privacy and fair elections. The institute's findings prompted bipartisan legislative responses, with Rep. Gina Johnsen expressing gratitude for the oversight. Concerns were also raised about liability provisions that might allow tech platforms to evade responsibility for underage users.

The bills mirrored legislation in other states, likely influenced by the Digital Childhood Alliance. Privacy advocate Eric Rasmussen noted the similarities and played a key role in the withdrawal effort. Sen. Ruth Johnson questioned whether the bills could be amended to address the issues.

Following advocacy efforts, the bills were withdrawn, and sponsors Rep. Brad Paquette and Sen. John Cherry are now collaborating with groups to draft new legislation. Advocates suggest incorporating these measures into a broader consumer data privacy framework, granting rights to data knowledge, deletion, and opting out of sales.

Patrice Johnson emphasized the power of grassroots organizations in shaping policy, thanking those involved for their vigilance. The Digital Childhood Alliance did not comment on the situation.
